Chapter 4
Shops & Establishment Act
A state-level workhorse law
The Shops and Establishment Act is enacted by each state and governs the working conditions of most commercial establishments — shops, offices, restaurants and the like. Almost every business with employees needs to comply.
Registration
Establishments must obtain a Shops & Establishment registration/licence from the local labour authority, usually within a set period of commencing operations. It is often a prerequisite for opening a current account, and renewal rules vary by state.
What it regulates
The Act governs working hours, weekly holidays, overtime, opening/closing times, leave (privilege/sick/casual), conditions for women's employment, prohibition of child labour, and maintenance of registers and records. Specifics differ across states.
Compliance discipline
Displaying the registration certificate, maintaining attendance and wage registers, granting statutory leave and respecting working-hour limits keep an establishment compliant. Inspectors can levy penalties for violations, so periodic self-audits are wise.
