Filing Trademark Application

The filing journey

Filing a trademark in India follows a defined path: search, application, examination, publication and registration. Knowing each stage helps you set expectations and respond on time.

Search and application

First, conduct a public search on the IP India portal to check for identical or similar marks. Then file Form TM-A with the mark, applicant details, class(es) and goods/services description. Startups and small entities pay a reduced government fee. On filing you receive an application number and may start using ™.

Examination and the examination report

The Registry examines the mark and may issue an examination report raising objections (absolute or relative grounds). You must respond within the prescribed time, often a month, possibly attending a hearing.

Publication and registration

If accepted, the mark is published in the Trademark Journal for a four-month opposition window. If no opposition succeeds, the Registry issues the registration certificate, valid for 10 years and renewable. From filing to registration typically takes 12–24 months when smooth.
