Trademark Renewal & Protection
Keeping the mark alive
A registered trademark is valid for 10 years and can be renewed indefinitely in 10-year blocks. Failing to renew can cost you the brand you built.
Renewal and restoration
File Form TM-R for renewal, ideally before expiry (a grace period with surcharge exists post-expiry). If the mark lapses, you may apply for restoration within a limited window. Beyond that, the mark can be removed and become available to others.
Enforcing your rights
Registration lets you sue for infringement (use of an identical/similar mark on similar goods) and seek injunctions, damages and account of profits. For unregistered or broader brand reputation, passing off remains available. Sending a cease-and-desist letter is often the first enforcement step.
Watch and protect
Proactive brand owners run watch services to spot conflicting applications early and oppose them, monitor marketplaces for counterfeits, and record their marks with customs to block infringing imports. Protection is ongoing stewardship, not a one-time event.
