FSSAI Compliance & Penalties
Ongoing compliance
FSSAI compliance is continuous: timely renewals, accurate annual returns (for manufacturers/importers), trained food handlers, hygiene ratings, and readiness for inspection.
The penalty regime
The FSS Act prescribes graded penalties. Sub-standard food and misbranding attract monetary penalties (often in lakhs). Unsafe food is far more serious: depending on whether it causes injury or death, penalties rise sharply and can include imprisonment. Operating without a licence attracts both a fine and imprisonment up to a specified term.
Adjudication and appeals
Minor offences are adjudicated by a Designated Officer/Adjudicating Officer; serious offences go to court. FBOs have rights of appeal to the Food Safety Appellate Tribunal. Sampling follows due process, and FBOs can seek a referee laboratory analysis.
Best practice
The cheapest compliance is proactive: license correctly, renew on time, implement FSMS, train staff, label accurately, keep records, and respond promptly to notices. A good FSSAI hygiene rating is also a marketing asset, signalling safety to customers.
